This FAQ explains how to submit claims and Proofs of Claim, respond to claim or lawsuit notices, and communicate with the Georgia Insurers Insolvency Pool (Pool). Eligibility and coverage depend on the applicable law and the facts of each claim.
The Pool cannot determine the timing of a settlement check until it receives and reviews your claim file. After the Pool receives the file, we will send you a letter with one or more affidavits to complete and return. Once the completed affidavit or affidavits are received, the Pool will contact you to discuss the claim and settlement process.
The Pool will make every reasonable effort to identify and address situations involving significant financial hardship or urgent circumstances. For example, claims involving essential property repairs, vehicle releases, or other time-sensitive matters may receive expedited attention when appropriate.
The Proof of Claim form is available at the link below. Complete the form and submit it to the Receiver’s address listed below.

Processing may be delayed after an insurer becomes insolvent because the Pool must obtain the claim files and related records from the Receiver or Liquidator before reviewing individual claims. Processing may take longer when records are incomplete, disorganized, or require additional review.

Claimants are encouraged to remain patient during the transition process. The Pool is committed to handling all covered claims as efficiently as possible while ensuring that all claims are reviewed in accordance with applicable law.
If you receive notice of or a lawsuit involving an insolvent insurer, you should contact the Pool via email [email protected] or call 770/621-9835 as soon as possible and provide copies of all relevant documents, including any claim forms, legal pleadings, summonses, complaints, or other correspondence related to the matter.
Whether a subrogation claim is a covered claim depends on the applicable provisions of Pool Act. Refer to the applicable law or contact GIIP directly for assistance in determining whether a particular subrogation claim may be eligible for coverage.
Potentially, yes. A bodily injury or property damage claim may qualify as a covered claim under the Georgia Insurers Insolvency Pool Act if it is an unpaid claim arising from an insured event covered by a qualifying insolvent insurer’s property or casualty policy and meets the Pool Act’s eligibility requirements. For a third-party liability claim, either the insured or the claimant must have been a Georgia resident at the time of the insured event. The Act also recognizes certain claims involving property permanently situated in Georgia. Coverage is not automatic merely because the claim involves bodily injury or property damage. O.C.G.A. § 33-36-3(4)(A)–(B). [codes.findlaw.com]
The claim remains subject to the policy’s terms and limits and the Act’s applicable exclusions and limitations, including insured net-worth requirements. If the claim is also covered by a solvent insurer’s policy, the claimant must first exhaust rights under that policy, and the amount recoverable from the Pool is reduced by amounts received from solvent insurers. The Pool must review the facts and available coverage before determining eligibility or payment. O.C.G.A. §§ 33-36-3(4)(G), 33-36-9, and 33-36-14(a).
